MINUTES OF THE REGULAR MEETING OF THE VIENNA
PLANNING BOARD HELD JANUARY 25, 2017

The meeting convened at 7:10 PM at the Town House. Regular members present were Waine Whittier, Ed Lawless, and Creston Gaither. Minutes of the December 14 meeting were read and accepted.

Creston reported that he found a survey map that indicates that the Ford cabin discussed in December in fact lies in Mount Vernon.

It was voted 3 – 0 to support the 50 foot setback that has been proposed to bring various land use ordinances into conformance with each other.

Waine’s Annual Report (for the Town Meeting Warrant) was reviewed and approved.

Planning Board Meeting - March 22, 2017

MINUTES OF THE REGULAR MEETING OF THE VIENNA
PLANNING BOARD HELD MARCH 22, 2017

The meeting convened at 7:00 PM at the Town House. Regular members present were Waine Whittier, Ed Lawless, Alan Williams, and Creston Gaither. Also present were Tom Ferraro and Burt Whittier. Minutes of the January 25 meeting were read and accepted. Note that no formal meeting was held in February. Creston and Waine met at the Town House on February 22 but, lacking a quorum, no formal business was conducted.

Tom Ferraro presented his application for a temporary dock on land his parents own which is depicted on tax map 11 as lot 45, on Parker Pond, including a Google Earth photo showing the proposed dock location. He was advised that Section C of the Shoreland Zoning Ordinance is the pertinent article. He has already obtained a Building Ordinance permit for a proposed structure on this parcel, and said that Code Enforcement Officer John Archard has determined that the structure site is at least 250 feet from the pond at high water mark. He presented a letter from the parcel’s owners (his parents) authorizing him to act as their agent in this matter. Given that the proposal is minimal and Creston and Alan have been to it a number of times the Board agreed to waive the usual site visit.

Based on Tom’s application and verbal representations and the Board’s knowledge of the site, the Board concluded that this project:

  1. Will maintain safe and healthful conditions
  2. Will not result in water pollution, erosion, or sedimentation to surface waters;
  3. Will adequately provide for the disposal of all wastewater;
  4. Will not have an adverse impact on spawning grounds, fish, aquatic life, bird or other wildlife habitat;
  5. Will conserve shore cover and visual, as well as actual, points of access to inland waters;
  6. Will protect archaeological and historic resources as designated in the comprehensive plan;
  7. Will avoid problems associated with floodplain development and use; and
  8. Is in conformance with the provisions of Section 15, Land Use Standards.


Tom said he expects Hammond Lumber Company to install the dock (though they are not yet formally committed)—he expects them to cart it from the house site to the installation site and was advised that cutting out a new path will not be permitted. And that a 6 foot wide meandering path would be permissible.

The Board voted 4 – 0 to authorize Creston to issue the usual permit by letter.

Burt Whittier inquired about regulations controlling a multi-unit building on a single parcel, i.e. a duplex with 2 units. He was advised that doing this on a relatively recent outconveyance could create third division that could trigger subdivision review requirements. He noted that it would be a commercial structure and was advised that Vienna has no ordinances specifically addressing commercial structures.

Prospective new Board members were informally discussed.

The Town of Vienna will hold a public hearing on proposed changes to the Vienna Building Ordinance, Monday, May 1, 2017 at 7 p.m. in the Community Room (Fire Station/Community Building). The following four options will be voted on, in a Special Election, Tuesday, May 16, 2017, from 3:00 PM to 8:00 PM in the Community Room.

For discussion:

1. To repeal one of the two conflicting amendments to the Building Ordinance that passed on March 10, 2017:

2. A proposal to repeal the amendments (that passed on March 10, 2017) to the Building Ordinance and task the Ordinance Review Committee and other interested parties to come up with a compromise proposal of changes to be presented at next town meeting – March 2018.

3. A Citizen’s Petition has been submitted that is proposing to repeal the Building Ordinance altogether, and adopt the (previous) “Notification of Intent to Build” Ordinance:

Assistant Coordinator for Neighbors Driving Neighbors (NDN)

A non-profit corporation providing free rides to residents of our 5-town service area. NDN’s mission is to enrich our communities by coordinating volunteer drivers who assist those who do not drive, so they can more easily remain in their homes.

Our vision is that central Maine communities will be a place where people of all ages are able to enjoy meaningful lives while living in their homes.

JOB DESCRIPTION

Neighbors Driving Neighbors will contract for the position of assistant coordinator of our rides program. NDN will provide the assistant coordinator contractor with support from the Board of Directors (Board) and the NDN coordinator, who will provide training and support. A cell phone to receive and make business calls will be shared between the assistant coordinator and the coordinator, and both will need their own computer to assist in scheduling and tracking rides.

QUALIFICATIONS

  • Compassion and empathy for riders needing our services
  • Willingness and ability to work with the population who will use our services such as seniors, handicapped individuals and others unable to drive for whatever reason.
  • Excellent telephone skills; patience with those who may have difficulty hearing on the phone
  • Clear speaking and writing abilities
  •  Able to work with Google Apps (Gmail, Contacts, Voice, Calendar, Maps and Drive), as well as MS Access Database, Word and Excel
  • Familiarity with the geography of the area and map reading skills
  • Understanding of volunteer needs and constraints on their availability
  • Preference given to resident applicants in our towns: Fayette, Rome, Belgrade, Mt. Vernon, and Vienna

STIPEND

NDN anticipates that during the first years of operation, the position will require 8 to 10 hours per week; NDN will pay a stipend the first 6 months of $1750, divided in two equal quarterly installments. The Board will adjust the stipend after the 6 months based on satisfactory performance, call volume, duty sharing, cooperation and cross coverage with coordinator, and other duties added in the future by joint agreement of Board, coordinator and the assistant coordinator.

This position will be as a contractor, like the coordinator, and will supply his/her own computer and other equipment, do the scheduling and driver supervision independently, collaborate with the Board on driver and rider recruitment, be paid a fixed contracted amount adjusted each year based on performance, and receive as benefits only liability insurance for this work from NDN.

Proposed Amendments to the Vienna Building Ordinance, Shoreland Zoning Ordinance, and Subdivision Regulations

The Town of Vienna will hold a public hearing on proposed regulatory changes 7pm, February 16, 2017 at the Vienna Community Building


1. The Ordinance Review Committee has submitted two proposals:

A)  The purpose of the proposed changes to the Building Ordinance, Shoreland Zoning Ordinance and Subdivision Regulations is to make the road setback requirements from public and private roads consistent among the three ordinances.

B)  The purpose of other proposed changes to the Subdivision Regulations and Building Ordinance is to clarify that the Subdivision Regulations apply to any mobile home park development, conforming to state law, proposed in the Town of Vienna.

Ordinance Review Committee Minutes - January 19, 2017

The Ordinance Review Committee met Thursday, January 19th at the Town House at 6:30 pm.  Marianne Archard and Susan Burns attended.

The first discussion item covered review of the proposed ordinance amendments on road setbacks and mobile home park subdivisions. Marianne agreed to make the changes necessary for the February public hearing.

The second discussion item concerned the public hearing date, time and location, set for the Ordinance Review Committee's regular meeting, February 19th at 7 pm in the Town House.

The discussion then covered the Committee's report for the Vienna 2016 Town Report and public notice for the February public hearing.  Susan agreed to draft the Committee's annual report and ordinance warrant articles and the public hearing notice.  Marianne agreed to post the public hearing notices with the proposed amendments at the Town House and Post Office and to send them to Jim Anderberg to post on the Town's website.

Ordinance Review Committee Minutes - December 15, 2016

The Ordinance Review Committee met Thursday, December 15th at the Town House at 6:30 pm. 


Committee members discussed the draft amendments to the road setback requirements following the work session with the Planning Board in November.  The November meeting resulted in a compromise, proposing a setback of a consistent 50-foot distance from public roads and maintaining a 40-foot distance from private roads in the draft amendments to road setback requirements in the Building Ordinance, Shoreland Zoning Ordinance and Subdivision Regulations. The November meeting also discussed reducing the building permit fees for so-called hoop and shed-in-a-box structures.  Susan agreed to revise the draft amendments for the Committee's January 2017 meeting.

Committee members also discussed adding the term 'mobile home parks' to the list of uses/types of residences covered by the Subdivision Regulations. The proposed changes would include applicable definitions of terms and incorporate appropriate references to Maine State statutes regarding municipal regulation of mobile home parks.  Susan agreed to draft the proposed subdivision amendments for the January 2017 meeting.

Planning Board Meeting - December 14, 2016

[NO MEETING IN NOVEMBER OR LATE DECEMBER]

Creston had advertised this meeting as a substitute for the regularly scheduled November & December meetings which were cancelled in view of the holidays. The meeting convened at 7:00 PM at the Town House. Regular members present were Alan Williams, Ed Lawless, and Creston Gaither. Alan was elected Acting Chairman in Waine Whittier’s absence. Minutes of the October 26 meeting were read and accepted.

Dan Huettner wants to jack up the Ford cabin on Flying Pond and replace the existing foundation. Alan said it may not need a Shoreland Zoning Ordinance permit as it may be more than 250 feet from the pond. No change in its footprint is proposed. It was agreed that Mr. Huettner should contact CEO John Archard. Alan will do this on his behalf.

Creston will see whether he has a survey map depicting this cabin.
